The English High Court has ruled that Australia's BHP is responsible under Brazilian law for the collapse of a tailings dam at the Fundão mine in the Brazilian state of Minas Gerais, which occurred in November 2015.

The court determined that BHP is considered a "polluter" under Brazilian environmental regulations and has breached the country's civil laws. The full amount of possible damages will be decided in future court cases, which are anticipated to be completed between 2028 and 2029. BHP has stated its intention to challenge the court's ruling.

The dam was managed by Samarco, a joint venture between BHP's Brazilian branch and Vale. When it collapsed, it caused the loss of 19 lives and polluted hundreds of kilometers of water systems.

In October 2024, Vale and BHP reached a $32 billion agreement with Brazilian authorities through civil legal actions connected to this event. BHP claims the ongoing UK legal case is akin to the situation in Brazil.
