The publication states that the Taliban has effectively eliminated the established minimum age for girls to marry, associating the right to marriage with the beginning of puberty. According to The Times, girls may start puberty between the ages of eight and 13. The publication states that the oldest and largest Sunni school of Islamic law considers nine as the minimum age for puberty.
Before the Taliban took control in Afghanistan, the legal minimum age for marriage, as per a law from 1977, was 16 years for girls and 18 years for boys. Girls younger than 16 may wed with consent from their father or a judge. Nevertheless, the 2009 Law on the Elimination of Violence against Women made marriages with girls below the age of 15 illegal. As reported by Amu TV, the Taliban leader Hibatullah Akhundzada sanctioned the new regulation, which has now come into effect.
UNICEF reports that 28% of Afghan women between 15 and 49 were wed before they turned 18. In a statement to The Times, global human rights authorities remarked that the enacted law essentially permits violence towards children.
