EC says it’s ready to take Hungary and Slovakia to court under REPowerEU plan

The European Commission has expressed support for the approval of the EU regulation that imposes a full ban on the import of Russian gas and is prepared to challenge this legislative decision in court, stated EC spokesperson Anna-Kaisa Ikonen.

"Similar to other legislative documents, the REPowerEU plan can be challenged by member states in court, and, naturally, we are ready to defend the Commission's stance in Luxembourg," she said during a press briefing.

This was her response to a question regarding Hungary and Slovakia's intention to take the European Court of Justice to task over the adoption on January 26 of the regulations imposing a total ban on Russian gas supplies and whether the Commission would defend itself, potentially delaying the implementation date of the new rules through court proceedings.

Ikonen did not comment on speculation about the future of this text or what will happen next, stating she prefers not to make any statements on the matter.


She described the implementation of the ban on Russian gas imports into the EU as a significant event for the European Union and "the final phase in the effort to completely stop importing Russian gas into Europe."

"We also aim to progressively phase out Russian oil," the Commission representative added. According to her, the Commission's current focus is on helping the EU move closer to the long-term goal they have been working towards. She also noted that "the majority of Member States have supported the Commission's position."
